Title Bond Glossary

The vocabulary of bonded titles, from the statutory terms the states use to the underwriting terms in the application.

Bonded title
A certificate of title issued by a state on the strength of a surety bond rather than an unbroken chain of ownership. Carries a brand for the bond term and converts to a clean title afterward.
Certificate of title surety bond
The formal name of the title bond in Texas, Florida, Georgia, Mississippi and others: a bond that indemnifies the state and any rightful claimant against loss arising from the issuance of a title to the principal.
Lost title bond
Industry shorthand for the same instrument, from the most common fact pattern: the title was lost before being transferred into the buyer's name.
Defective title bond
The name used where the title exists but is unusable: improperly assigned, altered, illegible or carrying a lien that cannot be released. New Mexico's official term.
Vehicle indemnity bond
North Carolina's term (MVR-92D Indemnity Bond), emphasizing that the bond indemnifies prior owners, lienholders and subsequent purchasers.
Vehicle ownership bond
Idaho's and Washington's term (ITD 3909; TD-420-054). California's REG 5057 is the Motor Vehicle Ownership Surety Bond.
Penal sum
The face amount of the bond, the maximum the surety will pay in aggregate. Set by the state as a multiple of the vehicle's value.
Multiplier
The statutory factor applied to the vehicle's value to fix the penal sum: 1.0, 1.5 or 2.0 depending on the state.
Principal
The applicant who buys the bond and whose claim of ownership the surety guarantees. Liable to reimburse the surety for any loss.
Obligee
The party protected by the bond: the state's titling agency and, through it, anyone with a superior claim to the vehicle.
Surety
The insurer that issues the bond. On this platform, Surety One, Inc., writing on carriers listed in Treasury Circular 570 and licensed in each state.
Indemnity agreement
The contract in the application under which the principal agrees to repay the surety for any payment, expense or attorney fee incurred under the bond, and to post collateral on demand.
Power of attorney
The surety's document authorizing the attorney-in-fact who signed the bond. Attached to every executed bond; most states reject a bond without it.
Standard Presumptive Value (SPV)
Texas's statutory vehicle value, used first when sizing a Texas bonded title bond.
Notice of Determination
Texas form VTR-130-ND, the TxDMV letter stating the bond amount and authorizing the applicant to proceed. Valid one year.
NMVTIS
The National Motor Vehicle Title Information System, the federal title history database that most states query before issuing a bonded title.
Brand
A legend printed on the title: BONDED, BOND POSTED, UNDISCLOSED INTEREST, SURETY BOND. Removed when the bond term expires without a claim.
Judgment underwriting
Individual review of a bond by an underwriter rather than automatic issuance. On this platform, every bond of $25,000 and greater.
Fully earned premium
A premium that is not refundable once the bond is executed, because the surety's obligation cannot be withdrawn during the statutory term.
Court-ordered title
The alternative to a bonded title in states that do not bond titles: a judge's order directing the titling agency to issue a title to the petitioner.
